THIS POLICY APPLIES TO ALL OF VALEŌ PILATES & WELLNESS STUDIO’S POLICIES INCLUDING (BUT NOT LIMITED TO) REFORMER AND MAT PILATES CLASSES AND HYDRO-SUITE THERAPY IN THE PRIVATE TREATMENT ROOM.
PLEASE READ THE STUDIO'S HYDRO-SUITE POLICY IN ADDITION TO THE FOLLOWING GENERAL HEALTH DISCLAIMER, WHICH APPLIES TO ALL VALEŌ PILATES AND WELLNESS STUDIO SERVICES.
**IMPORTANT DISCLAIMER: We emphasize this notice to ensure full transparency. It is crucial that you understand the implications of both our Pilates services and hydro-suite therapies (cold plunge and infrared sauna duo therapy).**
Health Disclaimer and Waiver of Liability
By using our facilities and services, you acknowledge and agree to the following:
1. ASSUMPTION OF RISK:
1.1- You understand that our treatments, including infrared sauna and cold plunge therapy, involve inherent risks. Our full spectrum infrared saunas reach temperatures of 158°F (70°C), and our cold plunges are maintained at temperatures between 45°F - 48°F (7°C - 9°C). You voluntarily assume all risks associated with these treatments.
1.2- You understand that participating in Pilates classes and exercises involves inherent risks. These risks may include, but are not limited to, muscle strains, sprains, joint injuries, falls, and in rare cases, more serious injuries. Pilates involves physical exertion, balance challenges, and the use of specialized equipment such as reformers, chairs, and springs. You acknowledge that the level of difficulty can be adjusted, but some risk remains even at lower intensity levels. You voluntarily assume all risks associated with participating in Pilates classes and exercises, including any risk of injury or aggravation of pre-existing conditions.
2. HEALTH CONDITIONS:
2.1- You affirm that you are in good health and do not have any medical conditions that may be adversely affected by extreme temperatures. If you have any doubts about your ability to safely use our facilities, you agree to consult with a qualified healthcare professional before participating.
2.2- You affirm that you are in good physical condition and do not have any medical conditions that may be adversely affected by Pilates exercises or equipment. This includes, but is not limited to, recent surgeries, acute injuries, severe osteoporosis, unstable blood pressure, or balance disorders. If you have any doubts about your ability to safely participate in Pilates classes or use Pilates equipment, you agree to consult with a qualified healthcare professional before participating. You also agree to inform the instructor of any physical limitations, injuries, or medical conditions that may affect your ability to safely perform Pilates exercises.
3. Pregnancy and Pilates Policy
3.1 Medical Clearance Requirement
3.1.1- Members who are pregnant must obtain explicit medical clearance from their obstetrician (OB) or family doctor before participating in any Reformer or Mat Pilates classes.
3.1.2- Written medical clearance must be provided to the studio before the member's first class after becoming pregnant.
3.1.3- The medical clearance should specifically state that the member is cleared to practice Pilates during pregnancy.
3.2- Pregnancy Notification
3.2.1- Members who are pregnant must inform their instructor of their pregnancy status before participating in any Reformer or Mat Pilates classes.
3.2.2- While Pilates can be beneficial during pregnancy, it also presents certain risks:
a) Abdominal strain due to stretching muscles
b) Reduced blood flow when lying on the back
c) Increased risk of falls or injuries due to hormonal changes affecting joint stability
3.3 Class Modifications
3.3.1- Pregnant members will be provided with appropriate modifications for all exercises.
3.3.2- Certain positions and movements may be restricted, especially after the first trimester.
3.3.3- Use of specialized equipment (e.g., pregnancy wedges) may be required.
3.4 Assumption of Risk
3.4.1- By participating in Pilates classes while pregnant, members acknowledge the inherent risks and agree to follow all instructor guidance and modifications. The studio reserves the right to refuse participation if deemed unsafe for the member or fetus.
3.4.2- While our instructors are trained in providing pregnancy modifications, they are not medical professionals. Members are responsible for communicating any discomfort or concerns during the class.
3.5 Ongoing Monitoring
3.5.1- Pregnant members are advised to consult with their healthcare provider regularly throughout their pregnancy regarding their fitness routine.
3.5.2- Members should inform the studio of any changes in their pregnancy status or medical advice received.
Adherence to this policy is mandatory for the safety of both the pregnant member and their unborn child. The studio is not liable for any pregnancy-related complications that may arise from participation in Pilates classes. Members are encouraged to listen to their bodies and prioritize their health and the health of their baby at all times.
3. CONTRAINIDITIONS
3.1- You agree not to use our treatment rooms if you are pregnant, have cardiovascular conditions, respiratory issues, or are under the influence of alcohol or drugs. You also agree not to use our facilities if you are even slightly susceptible or sensitive to hot and cold therapies.
3.2- You agree not to participate in Pilates classes or use Pilates equipment if you are pregnant (without prior approval from your healthcare provider), have uncontrolled cardiovascular conditions, severe respiratory issues, or are under the influence of alcohol or drugs. You also agree not to participate if you have any acute injuries, recent surgeries, or medical conditions that may be adversely affected by physical exercise.
3.3- You acknowledge that Pilates involves physical exertion, balance challenges, and the use of specialized equipment. If you are even slightly unsure about your ability to safely perform Pilates exercises, you agree to consult with a qualified healthcare professional before participating and to inform your instructor of any limitations or concerns.
4. NO MEDICAL ADVICE:
The information provided by our staff and on our website is for educational purposes only and does not constitute medical advice. We strongly recommend consulting with your healthcare provider before starting any new treatment regimen, like incorporating Pilates and/or hydrotherapies into your wellness routine.
5. WAIVER OF LIABILITY:
To the fullest extent permitted by law, you agree to waive any and all claims against our corporation, its owners, employees, and agents for any injury, illness, or damage resulting from the use of our facilities and services, including those arising from negligence.
6. INDEMNIFICATION:
You agree to indemnify and hold harmless our corporation, its owners, employees, and agents from any claims, demands, or damages, including legal fees, arising from your use of our facilities and services.
7. COMPLIANCE WITH INSTRUCTIONS:
You agree to follow all posted safety instructions and staff directives. Failure to do so may result in immediate termination of your session without refund.
8. HEALTH TRANSPERENCY:
You agree to disclose any relevant health conditions or concerns to our staff before using our facilities. Failure to do so may significantly increase your risk of injury or adverse effects, including death. There have been documented incidents in Canada and the United States where the sudden shock and temperature transition has resulted in cardiac arrest and subsequent death. Although rare, we are committed to full disclosure of this information to enable you to make an educated decision.
Our company is driven by integrity rather than profit, and your health is our top priority. Please help us through health transparency, so we can guide you in making informed decisions appropriate for your individual circumstances.
9. RIGHT OF REFUSAL:
We reserve the right to refuse service to anyone we believe may be at risk of adverse effects from our treatments.
10. AKNOWLEDGEMENT:
By using our facilities, you acknowledge that you have read, understood, and agree to all terms of this disclaimer and waiver.
